A 51-year-old man was arrested Tuesday night for failing to stop and render aid in an accident involving death.
James Madison Day was taken into custody after the Erath County Sheriff’s Office received a warrant for his arrest.
An arrest affidavit states that shortly before 10 a.m. on Oct. 6, authorities were dispatched to a stretch of highway in Huckabay for a report of a deceased person on the side of the road. DPS Trooper Chance Ensminger arrived on scene and discovered a deceased white male with injuries consistent with being struck by a vehicle. The victim was later identified as Isaiah Cutler.
Investigators found several vehicle parts and debris left at the scene. On Nov. 11 investigators received an anonymous tip that Day was involved.
That evidence matched a heavily damaged Ford pickup belonging to Day.
Day’s daughters told investigators that their father admitted to killing Cutler.
They said he told them he had gone to the Huckabay store to buy milk and while trying to pass a slow-moving vehicle, he struck Cutler.
Day is being held at the Erath County Jail. His bond had not been set as of Wednesday morning.
