Cody Robersonís court appointed attorney, Heath Allen, asked the court Monday for a change of venue, a motion District Court Judge Donald Jones said he would not rule on until there is proof that an unbiased jury cannot be seated.

Roberson has been charged in the January beating death of his mother, Jana Roberson. His attorney is requesting that the trial, scheduled to begin Aug. 13, be moved to another county because of pre-trial publicity. Jones said he would not rule on the motion until after a jury panel has been selected and interviewed to determine how much, if any, they know about the case.

The judge also ruled in favor of motions filed by both the state and the defense that would allow each side to have their own psychiatric expert evaluate Roberson for competency and sanity. The judge denied a separate motion by the defense for an additional psychological evaluation to be performed.
